Costumer defense

“In compliance with the settlement agreement reached in case file Nº 19018/2014 “CONSUMIDORES DAMNIFICADOS ASOCIACION CIVIL v. PRO MUJER SERVICIOS FINANCIEROS S.A. S/ ORDINARY”, pending before Commercial Court Nº 18, Secretariat Nº 36, Pro Mujer Servicios Financieros S.A. hereby informs that it will proceed to issue reimbursements in favor of clients and former clients who are individual end consumers, as set forth in the corresponding list, and for the amounts indicated therein. These reimbursements correspond to the total restitution of the differential resulting from comparing the average Total Financial Cost (CFT, by its Spanish acronym) of the financial system with the CFT applied by Pro Mujer Servicios Financieros S.A. (pursuant to the cap determined in the precedent “Consumidores Damnificados Asociación Civil v. Credil S.R.L. s/ordinary”, Case Nº 17.354/2013 before National Commercial Court of First Instance Nº 18, Secretariat Nº 36, under the formula: average CFT + 1.5 * average CFT), applicable to all loan portfolios that, between December 2016–December 2017 and May 2020–August 2020, exceeded the cited financial system average CFT, plus accrued interest from the date of the respective disbursement. Reimbursements for active clients will be applied as offsets against outstanding loans within twenty (20) business days following the final approval of the settlement, under the label “Loan Repayment Reimbursement.” For those clients where the offset results in a positive balance in favor of the user, and for former clients, account identification and a Uniform Banking Code (CBU) will be requested via COELSA, so that this clearinghouse, authorized by the Central Bank of Argentina (BCRA), may credit the reimbursements into any existing bank account of the beneficiaries in Argentina. Amounts that cannot be transferred to a bank account may be collected in person by their holders at PM’s registered office located at Av. Rivadavia 11008 (CABA). The agreement, the list of clients and former clients included, and the approving judgment may be consulted at www.pjn.gov.ar/consultadecausas, as well as at https://promujer.org/ar/es/, at PM branches, and in the court’s records. In all cases, the reimbursement shall be a one-time payment. Clients and former clients wishing to opt out of the terms of the settlement shall have the same period to do so in writing.”
